Years before the Jodi Arias trial lifted him to news TV stardom, veteran Maricopa County prosecutor Juan Martinez found himself locked in another stirring courtroom drama – the 2009 murder trial of Phoenix Suns nutritionist Douglas Grant.

Grant was charged with first-degree murder in the death of his wife Faylene. Specifically, the state accused Grant of drugging Faylene at their Gilbert home and watching her drown in a bathtub before perfunctorily calling for help.

The trial was desperate and nasty, a street fight. Bolstered by the discovery of several notes and letters that convincingly painted Faylene as suicidal, the defense seemed to have a fighting chance at an acquittal, or at least a hung jury.

Martinez knew the score. So, in his closing argument, the prosecutor sprung a brand-new theory on jurors. In a dramatic quasi-recreation, he demonstrated to jurors how Grant, whom he dubbed a “black angel of death,” had knelt next to his drugged wife and held her head underwater in the tub to ensure her end.

Trouble was, Martinez had no bona fide evidence, nada, to prove it. Courtroom theatrics and overkill had worked for him in the past, but this time didn’t pass muster with jurors. The panel deliberated for days before returning with a guilty verdict for manslaughter, much less serious than the first-degree murder count Martinez had urged.

Afterward, some jurors expressed confusion over the prosecutor’s 11th-hour ploy. “I didn’t get it,” a female juror told me at the time. “None of us liked Grant and we thought he was guilty of something. But only a few of us bought what Juan said at the end. It was weird.”

After a 30-year career as a prosecutor, high-profile lawyer Juan Martinez has agreed to be disbarred. 

The disbarment comes two days after a November trial had been scheduled involving a State Bar of Arizona complaint against Martinez.

The complaint involved allegations that Martinez sexually harassed women he worked with at the Maricopa County Attorney's Office. The state Bar, which investigates lawyers, also accused Martinez of leaking information to a blogger during the Jodi Arias murder trial and lying to investigators about having a sexual relationship with her. 

The State Bar of Arizona said in a statement on Friday, “this is a just outcome.” 

The former Maricopa County deputy attorney became a national household name during the Arias murder trial. 

However, he was dismissed from the County Attorney’s Office in February following several years of sexual harassment allegations. The office alleged that he had a pattern of unprofessional conduct. He called the office's actions "a vendetta," and was appealing the firing. 

By agreeing to be disbarred, court rules state that Martinez is not admitting to any misconduct, but is only confirming that he no longer wants to defend against the charges. 

Don Wilson, Martinez's lawyer, told The Arizona Republic that his client will not be commenting on his decision.

"But, I would be remiss if I did not point out on his behalf that this does not represent an admission of misconduct on his part nor can it be interpreted as an adverse judicial finding as to any of the allegations," Wilson said.

In 2019, the State Bar filed a formal complaint against Martinez alleging misconduct.

It accused him of sexually harassing coworkers and a Maricopa County Superior Court employee, communicating with a juror, and having a relationship with a blogger while trying to get her to leak information.

“Unexpected … When I wrote the book it was intended to get the story out there … how I went from charging Jodi Arias for the murder – and then the trial and tribulations – to when she takes the stand for 18 days. There’s always a fear that the jury is going to identify with her. So I wanted to get the story out there. But a best-seller, I still can’t believe it. It’s gratifying. I didn’t realized people would still be interested in a trial that started in 2012. Readers can actually read what I left out. And get answers to: ‘Why did I ask (Arias) this question or that?’ ”
